New regulations on minimum wage and overtime pay

The minimum wage is the lowest level paid to workers doing the simplest work, under normal conditions and must ensure the minimum living needs of workers and their families. The minimum wage is determined by month, day, hour and is established by region and industry. The Government announces the regional minimum wage on the basis of recommendations of the National Wage Council (The National Wage Council is an advisory body to the Government, including members who are representatives of the Ministry of Labor - Invalids and Social Affairs, Vietnam General Confederation of Labor and employers' representative organizations at the Central level).

The industry minimum wage is determined through industry collective bargaining and is stated in the industry collective labor agreement but must not be lower than the regional minimum wage announced by the Government.

Employees who work on holidays or days off are paid 300% of the normal working day. In addition, employees who work overtime at night are also paid an additional 20% of their salary calculated based on the salary unit price or salary based on work done during the day.

The maximum number of overtime hours must not exceed 50% of the normal working hours in a day. In case the weekly working regulations apply, the total number of normal working hours and overtime hours must not exceed 12 hours/day. , no more than 30 hours/1 month and no more than 200 hours/1 year; Except for special cases prescribed by the Government, it must not exceed 300 hours/year.

In addition to ensuring the rights and interests of employees, the 2012 Labor Code also ensures the legitimate rights of employers in the recruitment and employment process, ensuring harmonization of regulations. on labor issues in international treaties to which Vietnam is a member, especially the Convention of the International Labor Organization (ILO).
